Welcome to the Kempton Fair website (https://www.kemptonfair.org/). The Kempton Fair is an annual event presented by and for the benefit of the Kempton Community Center ("KCC," "we," "us," or "our"). By accessing this website, submitting any online forms, or attending the Kempton Fair, you agree to be bound by the following Terms and Conditions.
1. Event Information and Admission
Scope of Event: The Kempton Fair is held at 83 Community Center Drive, Kempton, PA. Admission typically includes access to main stage music, midway shows, tractor pulls, livestock exhibits, farm and craft exhibits, and parking. Schedule and Changes: We reserve the right to modify, postpone, or cancel scheduled events, pulls, or entertainment due to weather, safety concerns, or other unforeseen circumstances. Animal Policy: For the safety of our livestock and guests, and in strict accordance with the ADA, only trained service animals are permitted on the fairgrounds. Pets, comfort animals, and emotional support animals are strictly prohibited.
2. Forms, Submissions, and Exhibitors
Online Forms: Our website provides forms for livestock exhibits, farm/craft exhibits, sponsorships, and vendor applications. By submitting a form, you certify that all provided information is accurate and complete. Premium Book Compliance: All competitive exhibits, health requirements for livestock, and vendor operations are governed by the rules outlined in our annual Premium Book. All exhibitors and participants agree to abide by the specific rules and regulations contained therein.
3. Livestock and Agricultural Liability
Nature of Exhibits: Attendees and participants acknowledge that the fair involves live animals, heavy agricultural machinery, and power pulls. Assumption of Risk: Participation as an exhibitor or attendance as a guest involves inherent risks. By entering the fairgrounds, you voluntarily assume all risks related to exposure to animals, crowds, and farm equipment. Damage/Loss: The Kempton Community Center is not responsible for the loss, theft, or damage of any personal property, machinery, or livestock brought to the fairgrounds.
4. Photography and Media Release
By entering the Kempton Fairgrounds or participating in fair events, you consent to be photographed, filmed, and/or otherwise recorded by official Kempton Community Center staff, volunteers, or authorized event photographers. You grant the Kempton Community Center the irrevocable right and permission to use, publish, reproduce, and distribute these photographs and video recordings (no audio) for any lawful purpose. This includes, but is not limited to, use on the Kempton Fair and Kempton Community Center websites, social media pages, photo galleries, advertising, and other promotional materials, without compensation, prior notice, or further approval. If you do not wish to be photographed, please notify the photographer or fair staff on-site; however, we cannot guarantee your exclusion from background shots of large public crowds, midway areas, or grandstand events.
5. Website Use and Intellectual Property
All content on this website, including logos, text, schedules, graphics, and photo galleries, is the property of the Kempton Community Center and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without our express written permission.
6. Limitation of Liability
To the maximum extent permitted by applicable law, the Kempton Community Center, its Board of Directors, volunteers, sponsors, and representatives shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the website, submission of online forms, or attendance at the Kempton Fair.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal action or proceeding related to our website or event shall be brought exclusively in the state or federal courts located in or near Berks County, Pennsylvania.

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the website after any modifications constitutes your acceptance of the revised Terms.
